Master Rental Agreement & Terms of Service
These Terms and Conditions constitute a legally binding agreement between Go-Wheels Car Hire & Sales Ltd (“Go-Wheels”, “Company”, “we”, “our”, or “us”) and the person or entity renting or operating the vehicle (“Renter”, “Client”, “Driver”, or “User”).
By booking, paying any deposit, accepting delivery, or taking possession of a vehicle, the renter acknowledges that they have read, understood, and agreed to these Terms.
Failure to comply with any part of these Terms may result in immediate termination of the rental agreement and financial liability to the renter.
1. Booking & Reservation Terms
A booking becomes valid and enforceable only after:
- Go-Wheels confirms vehicle availability
- The renter pays the required booking deposit
- The renter completes identity verification (KYC)
Go-Wheels reserves the right to decline or cancel a booking at its sole discretion if verification requirements are not met.
A confirmed booking represents a legally binding reservation of company resources.
2. Mandatory Identification & Verification
Before a vehicle is released, the renter must provide:
• National ID or Passport
• Valid driving license
• Physical address
• Active phone number
• Emergency contact
• Additional verification documents where required
Go-Wheels may conduct background checks, verification calls, or digital screening to verify identity.
Failure to provide verification documents voids the reservation.
3. Driver Eligibility
The renter must:
• Be at least 24 years old
• Hold a valid driving license for at least 2 years
• Be mentally and physically capable of driving
Go-Wheels reserves the right to refuse rental to any person considered unsafe, intoxicated, or unreliable.
4. Payment Terms
All prices are in Kenya Shillings (KES) unless stated otherwise.
Payments may include:
• Rental fee
• Security deposit
• Delivery charges
• Insurance charges
• Optional services
Full or partial payment constitutes acceptance of this agreement.
5. Security Deposit & Financial Liability
A refundable security deposit must be paid before vehicle release.
The deposit protects Go-Wheels against:
• Damage to vehicle
• Traffic violations
• Parking fines
• Toll charges
• Lost accessories
• Cleaning charges
• Fuel shortages
• Late return penalties
• Insurance excess
• Vehicle recovery expenses
• Loss of rental income due to repairs
Go-Wheels reserves the right to deduct any such costs from the deposit without prior consent.
If costs exceed the deposit amount, the renter remains fully liable for the balance.
6. Cancellation Policy
Customer cancellations are subject to the following:
48+ hours before booking:
Full refund.
24–48 hours before booking:
50% refund.
Less than 24 hours:
Deposit non-refundable.
Once Go-Wheels has begun:
• administrative processing
• vehicle preparation
• delivery scheduling
the booking may incur non-refundable operational charges.
If Go-Wheels cannot provide the vehicle, the renter receives a full refund.
7. Vehicle Condition & Inspection
All vehicles undergo joint inspection at delivery and return.
Inspection includes:
• mileage
• fuel level
• tyres
• body condition
• accessories
The renter accepts the vehicle as delivered unless discrepancies are reported immediately.
Failure to report issues at delivery implies acceptance of vehicle condition.
8. Proper Use of Vehicle
The vehicle must only be used for lawful personal transportation within the declared itinerary.
Prohibited uses include:
• reckless driving
• racing or competitions
• off-road driving (unless approved)
• transporting illegal goods
• towing trailers without permission
• carrying passengers for hire without approval
• allowing unauthorized drivers
Any such use constitutes material breach of contract.
9. Negligence & Driver Responsibility
The renter must operate the vehicle with reasonable care and diligence.
Negligence includes:
• driving under the influence of alcohol or drugs
• excessive speeding
• reckless driving
• ignoring dashboard warning lights
• driving without oil or coolant
• driving with mechanical faults
• misuse on rough terrain
• allowing unlicensed drivers
Damage caused through negligence voids insurance coverage.
The renter becomes liable for full repair or replacement cost.
10. Traffic Violations, Tolls & Government Charges
The renter is responsible for all penalties incurred during the rental period, including:
• traffic fines
• speed camera tickets
• parking charges
• toll fees
• impound fees
• NTSA violations
If such charges are received after return, the renter must settle within 3 hours of notification.
Failure to settle may result in:
• deposit deductions
• legal recovery proceedings
11. Cross-Border Travel
Vehicles may not leave Kenya without written authorization.
Authorized cross-border travel requires:
• COMESA insurance
• border documentation
Unauthorized cross-border travel:
• voids insurance
• transfers full financial liability to renter
The renter becomes liable for full replacement value of the vehicle if lost or impounded.
12. Insurance Coverage
All Go-Wheels vehicles carry comprehensive insurance subject to an insurance excess.
Insurance does NOT cover:
• negligent driving
• drunk driving
• unlicensed drivers
• unauthorized drivers
• illegal activity
• cross-border violations
• off-road misuse
In such cases the renter is liable for full financial damages.
13. Accidents & Incident Reporting
In case of accident:
- Stop immediately.
- Notify Go-Wheels immediately.
- Call the police.
- Obtain a Police Abstract.
- Take photos of the scene.
- Provide witness contacts.
Failure to follow this procedure may invalidate insurance.
The renter remains responsible for insurance excess and loss of use charges.
14. Breakdown & Mechanical Responsibility
Go-Wheels provides roadside support where applicable.
However breakdowns caused by renter negligence including:
• running out of fuel
• overheating
• ignoring warning lights
are the renter’s responsibility.
All related costs including towing and repairs will be charged to the renter.
15. Vehicle Recall & Remote Immobilization
Go-Wheels reserves the right to remotely disable, track, or recover the vehicle without notice if:
• payment default occurs
• vehicle misuse is suspected
• illegal activity is suspected
• itinerary breach occurs
The renter remains liable for all recovery costs.
16. Vehicle Return
The vehicle must be returned:
• on agreed date and time
• in same condition
• with same fuel level
• clean interior
Charges apply for:
• late return
• cleaning
• fuel deficit
17. Limitation of Liability
To the fullest extent permitted by law:
Go-Wheels shall not be liable for:
• personal injury
• loss of personal property
• indirect damages
• business losses
• missed flights or appointments
arising from vehicle use.
18. Indemnity
The renter agrees to indemnify and hold harmless Go-Wheels, its directors, employees, and partners from all claims arising from vehicle use.
19. Privacy & Data Protection
Go-Wheels collects personal data only for:
• identity verification
• booking management
• legal compliance
We comply with the Kenya Data Protection Act.
20. Terms for Vehicle Owners (Fleet Partners)
Vehicle owners leasing vehicles to Go-Wheels must ensure:
• valid comprehensive insurance
• legal ownership documentation
• roadworthy condition
Theft Cases
In case of theft:
• Go-Wheels cooperates with police and insurers
• compensation depends on insurance settlement
Go-Wheels shall not be liable for losses not covered by insurance.
Insurance Limitations
Insurance does not cover:
• engine wear
• mechanical breakdown
• prior undisclosed damage
• expired insurance policies
21. Governing Law
These Terms are governed by the laws of the Republic of Kenya.
All disputes shall be resolved in Kenyan courts.
