Comprehensive Terms, Conditions & Policies
Welcome to Go-Wheels Car Hire & Sales Ltd (“Go-Wheels,” “we,” “our,” “us”).
We are honoured to be your mobility partner and we take pride in providing safe, well-maintained vehicles.
These Terms form a legally binding contract between Go-Wheels and every person or entity (the “Renter,” “Client,” or “Driver”) who books, pays for, or takes possession of a Go-Wheels vehicle.
By reserving a vehicle, paying any portion of the hire fee, or accepting delivery, you confirm that you have read, understood, and agreed to be bound by these Terms and Policies.
1. Booking, Identification & Acceptance
- Reservation & Confirmation – A booking is confirmed only after Go-Wheels issues written or digital confirmation following receipt of the agreed deposit or full payment.
- Mandatory Identification (KYC) – Before release of any vehicle, the renter shall provide the KYC documents requested for.
- Minimum Age – The primary driver must be at least 24 years old unless Go-Wheels grants written consent.
2. Payment & Security Deposit
- Rates & Currency – All prices are in Kenya Shillings and subject to applicable taxes, levies, or surcharges.
- Security Deposit – A refundable deposit is payable before the vehicle is released and may be applied toward damages, insurance excess, cleaning, fuel deficits, traffic fines, towing, recovery, downtime rental, or any breach-related costs.
- Acceptance by Payment – Payment of any rental invoice, even without signature, constitutes full acceptance of these Terms and has the same legal effect as a signed contract.
3. Vehicle Condition, Inspection & Responsibilities
- Joint Inspection – A detailed inspection form noting mileage, fuel level, tyre condition, and accessories is completed and signed at both hand-over and return.
- Maintenance During Hire – The renter shall keep the vehicle in good condition, routinely check oil, coolant, tyre pressure (including spare), brake fluid, battery, lights and wipers, and immediately report any mechanical issues.
- Accessories – All accessories (spare tyre, jack, tools, mats, fire extinguisher, first-aid kit, reflective triangles) must be returned intact.
4. Proper Use of Vehicle
The vehicle may only be used for lawful personal or business transport within the area and purpose declared on the booking invoice.
Prohibited uses include, but are not limited to:
- Racing, rallying, off-road driving (unless the vehicle is a 4×4 hired for that specific purpose) or transporting hazardous materials.
- Carrying passengers or goods for hire or reward without written consent.
- Towing, pushing, or propelling any trailer or vehicle.
- Taking small saloon or compact vehicles onto rough terrains or national parks where ground clearance is inadequate.
- Allowing any unlicensed, incompetent, or unauthorized person to operate the vehicle.
- The renter is fully responsible for all damages, costs, and liabilities caused by such unauthorized use.
5. Itinerary Disclosure & Non-Disclosure Breach
- Full Disclosure – The renter must declare all intended destinations and general itinerary at the time of booking.
- Material Breach – Failure to disclose a destination, cross-border plan, or significant detour constitutes a material breach.
- Go-Wheels may remotely disable or recall the vehicle without notice.
- All rental fees, deposits, and any recovery expenses will be forfeited, and the renter remains liable for additional costs of retrieval, towing, or security.
6. Cross-Border Travel
- Advance Permission – Any travel outside Kenya (e.g., Uganda, Tanzania, Rwanda) must be declared at booking. Go-Wheels will arrange COMESA insurance and border documentation.
- Unauthorized Cross-Border Use – Taking a vehicle outside Kenya without written authorization voids insurance and places full financial, civil, and criminal liability on the renter, including impound fees, border penalties, and total replacement value if the vehicle is lost or damaged.
7. Insurance, Liability & Accidents
- Comprehensive Cover – All Go-Wheels vehicles carry comprehensive insurance subject to an insurance excess per incident.
- Renter’s Financial Responsibility – The renter is fully responsible for:
- The insurance excess for each separate incident.
- Any loss or damage where insurance declines coverage (e.g., drunk driving, unlicensed driver, reckless or negligent conduct, unauthorized cross-border travel, or breach of these Terms).
- All scene costs including police abstracts, towing, recovery, storage, and related expenses.
- Accident Procedure When Renter Is at Fault –
- Stop immediately and ensure safety of all occupants.
- Notify Go-Wheels and the police without delay.
- Remain at the scene until the police arrive and a formal report is issued.
- Obtain a Police Abstract and provide photos and witness contacts.
- The renter shall cooperate fully with Go-Wheels and its insurers for the entire duration of the insurance claims process, including providing statements, attending hearings or assessments, and signing any required documents until the claim is finalized.
- The renter remains liable for all insurance excesses and for any costs or damages that insurance does not cover (including loss-of-use charges for downtime).
- Accident Procedure When Renter Is Not at Fault –
- The renter must still follow all steps above, remain at the scene, and pursue compensation directly with the third-party driver or their insurer before departing.
- Go-Wheels will assist where possible but assumes no obligation for third-party recovery.
- Prohibition of Unauthorized Drivers –
- The renter shall not give, lend, or permit the vehicle to be driven by any incompetent, unauthorized, or unlicensed driver.
- The renter is fully liable for any damage, loss, or claims arising when the vehicle is operated by such a person.
- Indemnity – To the maximum extent permitted by Kenyan law, the renter indemnifies and holds harmless Go-Wheels, its directors, officers, employees, and agents from any and all claims, damages, losses, injuries, penalties, or expenses arising from the use or possession of the vehicle.
8. Breakdowns, Repairs & Roadside Support
- Go-Wheels provides 24/7 roadside assistance.
- No repairs, modifications, or garage visits are allowed without prior written approval.
- In case of breakdown due to renter negligence (e.g., running out of oil or fuel), the renter bears all costs of towing, repairs, and downtime rental.
9. Extension, Recall & Early Termination
- Extension – Any extension must be requested and approved before the current rental period expires.
- Right of Recall – Go-Wheels may recall or disable the vehicle at any time for suspected misuse, itinerary breach, cross-border violation, late payment, or illegal activity.
- Refunds – Unused rental days will not be refunded if recall or termination is due to renter breach.
10. Traffic Fines & Government Charges
All traffic offences, tolls, e-toll fees, parking tickets, impound fees, or other government charges incurred during the rental period are the renter’s sole responsibility and must be settled within three (3) hours if billed after return.
11. Vehicle Return
The renter shall return the vehicle:
- On or before the agreed date and time,
- In the same condition as received (normal wear and tear excepted),
- With the same or higher fuel level and a clean interior/exterior.
Any deficit in fuel or cleaning will be billed at prevailing market rates plus a handling fee.
12. Privacy & Data Protection
Go-Wheels collects and processes personal data solely for booking, safety, and regulatory compliance.
We adhere to Kenya’s Data Protection Act and never sell personal data to third parties.
13. Force Majeure
Go-Wheels is not liable for any delay or failure to perform obligations under these Terms if such delay or failure results from events beyond our reasonable control, including natural disasters, strikes, government restrictions, or national emergencies.
14. Governing Law & Jurisdiction
This Agreement is governed by the laws of the Republic of Kenya.
Any dispute shall be subject to the exclusive jurisdiction of the Kenyan courts.
